1. Acceptance of these terms
By using passionatepoodles.com, you agree to these terms. If you don't agree, please don't use the site.
2. About this site
Passionate Poodles operates this site. We are a family-run Toy Poodle breeder in Conestoga, Pennsylvania, owned by Sylvia and Samuel Fisher. This site provides information about our program and our available and upcoming puppies.
3. Using our site
You agree to use the site lawfully and not to interfere with it, misuse our forms, or attempt to access areas you're not authorized to.
4. Puppy listings, availability, and pricing
We work to keep listings accurate. Availability, details, and pricing can change without notice. A listing is not an offer and does not guarantee that a particular puppy will be available to you. We confirm the final price for your puppy in writing before you place a deposit.
5. Waitlist and applications
To adopt a puppy, start by submitting an application. Submitting an application, or joining our waitlist, does not create a contract, reserve a puppy, or guarantee placement. We review every submission and follow up personally. In some cases we may not be able to move forward with a placement.
6. Reservations, deposits, and payment
We do not collect payments through this website. After we review your application and agree on a puppy, we arrange your deposit and payment with you directly.
A $500 deposit reserves your puppy. We apply the deposit toward your puppy's total price.
-
If you decide not to move forward, the deposit is non-refundable.
-
If we cannot provide the puppy you reserved, we refund your deposit in full.
-
Your remaining balance is due on or before the day you pick up your puppy.
A deposit does not transfer ownership. Ownership transfers when the balance is paid and your puppy goes home.
Adoption is also governed by our puppy contract and our 2-Year Genetic Health Guarantee, both signed at pickup. Where those signed documents and these terms differ, the signed documents control. See our Refund and Return Policy.
7. Health guarantee and your rights under Pennsylvania law
Every Passionate Poodles puppy comes with a written 2-Year Genetic Health Guarantee, signed at pickup. If a licensed veterinarian diagnoses a life-altering genetic or hereditary condition within two years of your adoption date and we validate the claim, you choose a replacement puppy of equal value from our next available litter, or a full refund of your puppy's adoption price. The guarantee covers diagnosed life-altering genetic and hereditary conditions. It does not cover common illnesses, parasites, injuries, veterinary bills, travel, or other related costs. Full terms are on our Health Guarantee page and in the agreement you sign at pickup.
Pennsylvania law gives dog buyers separate rights that apply alongside our guarantee. Our guarantee does not replace or limit them. In summary: if a licensed veterinarian determines within 10 days of purchase that your puppy is clinically ill from a contagious, infectious, or parasitic illness that renders it unfit for purchase, or certifies within 30 days of purchase that your puppy has a congenital or hereditary defect that adversely affects their health, you may return the puppy for a full refund, return the puppy for a replacement of equal value, or keep the puppy and receive reimbursement for reasonable veterinary costs up to the purchase price. Notice deadlines and a veterinarian's written certification apply. You receive a full written summary of these rights at the time of sale.
THIS DISCLOSURE OF RIGHTS IS A SUMMARY OF PENNSYLVANIA LAW. THE ACTUAL PROVISIONS OF THE LAW ARE IN SECTION 9.3 OF THE UNFAIR TRADE PRACTICES AND CONSUMER PROTECTION LAW.
8. Registration paperwork
Where we advertise a puppy as AKC registered or registrable, we provide the breeder's name and address, the names and registration numbers of the dam and sire, and the registry's name and address at the time of sale. We provide the documentation needed to register your puppy within 120 days of the sale date.
9. Pickup and delivery
Puppies go home by in-person pickup in Conestoga. Third-party delivery may be available at your cost and by your arrangement. We are not the carrier and are not responsible for delays, conditions, or events during third-party transport.
10. Photos and content
Text, branding, photography, and other content on this site belong to Passionate Poodles or are used with permission. Do not reproduce them without our written consent.
11. Your information
When you contact us or submit a form, we collect the information you provide so we can respond and manage our waitlist. See our Privacy Policy for details.
12. Links to other sites
We may link to third-party sites, including Happy Paws Grooming. We're not responsible for their content or practices.
13. Disclaimers and limitation of liability
[ATTORNEY-DRAFTED SECTION. Replace before publishing. Standard site disclaimers and liability limits tailored to Pennsylvania law and the sale of live animals. Must not conflict with the buyer remedies in 73 P.S. § 201-9.3.]
14. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute will be brought in the state or federal courts serving Lancaster County, Pennsylvania.
15. Changes
We may update these terms. The current version is always posted here with its effective date.
